Gabon, Douze prévenus impliqués dans cinq affaires de trafic de faune condamnés à des peines de six à douze mois de prison
Trafic de faune la justice gabonaise sans pitié pour les délinquants faunique. A l’issue d’une audience tenue le 10 juin 2022, le Tribunal spécial de Libreville a condamné douze (12) prévenus à des peines allant de six à douze mois de prison et aux paiements d’amende à l’État gabonais et dommages et intérêts pour l’administration des eaux et forêts.
Ces douze prévenus étaient poursuivis pour trafic d’ivoire et ont été arrêtés pour la plupart lors des opérations de lutte contre la criminalité faunique, menée par les forces de l’ordre et les eaux et forêts avec l’appui de l’ONG Conservation Justice. Le Tribunal a rendu son verdict dans cinq affaires. Notamment la complicité de tentative de commercialisation de pointes d’ivoire, la détention et la tentative de commercialisation des pointes d’ivoire. DINDOU Magui, TCHEUKAM Éric et NZIENGUI MOUVONDO Murielle sont condamnés chacun à douze (12) mois d’emprisonnement dont six (6) mois avec sursis, une amende de 1.750.000 FCFA et 1.000.000 FCFA à titre de dommages et intérêts à l’administration des Eaux et Forêts. La Détention illégale d’ivoire et tentative de commercialisation de pointes d’ivoire. Le tribunal spécial condamne MONDJO Aimé à douze (12) mois d’emprisonnement ferme et à une amende de 2.000.000 FCFA. La Tentative de commercialisation de pointes d’ivoire, détention illégale de pointes d’ivoire et tentative de commercialisation de trophées d’une espèce intégralement protégée.
NGUEMA NGOMO Célestin, ABENE NDOUNA Kizito Morten et ABOUI NDONG Jean Blaise sont condamnés à douze (12) mois d’emprisonnement ferme a sorti de six (6) mois avec sursis et à une amende de 1.500.000 FCFA. Le tribunal les condamne également à payer la somme de 5.000.000 FCFA à titre de dommages et intérêts à l’administration des Eaux et Forêts, pour les motifs suivants: Tentative de commercialisation de pointes d’ivoire, délit de détention illégale de pointes d’ivoire.
MOUANGA MBOUTSOU Béranger, TATY Pierre et MBOUTSOU Lary sont également condamnés à douze (12) mois d’emprisonnement ferme dont trois (3) mois avec sursis et à une amende de 3.050.000 FCFA chacun, pour:Détention et tentative de commercialisation de pointes d’ivoire. OBISSA Carle et MOUTOU Guillaume sont condamnés à douze (12) mois d’emprisonnement ferme dont six (6) mois avec sursis et à une amende de 1.600.000 FCFA chacun. Le tribunal les condamne également à payer la somme de 1.000.000 FCFA à titre de dommages et intérêts.
Pour rappel, TCHEUKAM Éric, NZIENGUI MOUVONDO Murielle et DINDOU Magui avaient été interpellés à Libreville alors qu’ils s’apprêtaient à vendre deux pointes d’ivoire. ABOUI NDONG Jean Blaise, NGUEMA NGOMO Célestin et ABENE NDOUNA Kizito Morten avaient été interpellés à Oyem en flagrant délit de commercialisation de quatre (4) pointes d’ivoire, trois (3) peaux et cinq (5) dents de panthère et une queue d’éléphant. MONDJO Aimé avait été arrêté à Koula-Moutou en possession de deux pointes d’ivoire sciées en six (6) morceaux qu’il était sur le point de vendre et OBISSA Carle et MOUTOU Guillaume avaient été interpellés en flagrant délit de possession et tentative de vente de deux pointes d’ivoire à Franceville.
Précisons que le Code pénal en République gabonaise prévoit jusqu’à dix ans de prison, en son article 388, pour les infractions liées au trafic d’ivoire. Pour les défenseurs de l’environnement, les peines infligées pourraient paraître peu dissuasives en comparaison des sanctions maximales prévues dans la législation. D’un autre côté, le taux de condamnation à des peines de prison ferme est élevé : 80 à 90% des présumés trafiquants d’ivoire sont condamnés à des peines de prison ferme.
Le Gabon mise sur la protection de sa biodiversité, notamment pour lutter contre le changement climatique qui sera un des enjeux de la prochaine conférence des parties sur la biodiversité (COP15). Le Gabon plaide en effet pour des “crédits Biodiversité” sur le modèle des « crédits Carbone », titre « Sciences et Avenir », un média spécialisé auquel une interview a été accordée à ce sujet par le Pr Lee White, Ministre des Eaux, des Forêts, de la Mer, de l’Environnement, chargé du Plan Climat, des Objectifs du Développement Durable et du Plan d’Affectation des Terres.Tout ceci est le fruit des actions menées par l’ONG Conservation Justice.
